Avenatti told CNN that Cook County prosecutors investigating the allegations facing the embattled singer were given the tape last weekend on behalf of his client, a "whistleblower" who previously worked with the star.
The Cook County State's Attorney's Office tells Yahoo, "We can not confirm nor deny an investigation".
"Mr. Kelly is a predator and a criminal who has preyed on young, vulnerable girls for far too long", Avenatti wrote.
A new video tape showing R. Kelly performing sexual acts on a girl has surfaced, which will be crucial evidence in his possible indictment.
Foxx asked potential victims to come forward last month after Lifetime aired the documentary "Surviving R. Kelly", which revisited the allegations against Kelly and put a spotlight on new ones. Six times the girl refers to her genitalia as 14 years old. "Avenatti says some guy says he knows the girl. Further, the time frame of the sexual assaults depicted in the video is within the IL statute of limitations", he said. In that series, women said Kelly kept them in abusive sexual relationships.
An attorney for Kelly, Steve Greenberg, did not immediately respond to Variety's requests for comment, although he told CNN on Thursday that he had not heard of the development.

Kelly's attorney told the network, "We are unaware of any new information involving Mr. Kelly".

Avenatti makes it clear in his press release that this video is new and has never been seen before.
"The time has come for him to finally be held accountable for his actions", he said.
Prosecutors in IL are moving to indict the 52-year-old Kelly, and he may be arrested imminently, a senior law-enforcement official told the New Yorker's Jim DeRogatis, who first anonymously received and exposed another tape in 2002 that allegedly depicted Kelly. The tape, witnesses and other information were turned over to the Cook County State's Attorney's Office.
