On Feb. 12, Chicago police said Smollett turned over some, but not all, of the phone records detectives requested as part of their investigation.

In a new statement, 20th Century Fox Television and Fox Entertainment tell PEOPLE: "Jussie Smollett continues to be a consummate professional on set and as we have previously stated, he is not being written out of the show".

- Chicago police say they're still seeking a follow-up interview with Smollett after receiving new information that "shifted" their investigation of a reported attack on the "Empire" actor. He also claimed they told him that it was "MAGA country", a reference to Donald Trump's campaign slogan.

The Chicago Tribune notes that no further information has been provided about the witnesses or Foxx's relationship to them; the announcement came hours after the two brothers who were originally arrested in the case, Olabinjo and Abimbola Osundairo, spoke with prosecutors and detectives at the courthouse.

"The FBI and the US Postal Inspection Service are now investigating whether Jussie Smollett played a role in sending a threatening letter addressed to him at "Empire's" Chicago studio prior to the alleged attack", ABC News reported, after confirming with two federal officials. Smollett also was later charged with false impersonation, driving under the influence and driving without a valid license.

It's unclear what the defense said, but the Cook County state's attorney chose to postpone the brothers' testimony, which would have been the first step toward indicting the 36-year-old actor for filing a false police report.

The brothers told law enforcement that they rode around with Smollett to find a location for the attack.

Jussie and his attorneys anticipate being further updated by Chicago Police Department on the status of the investigation and will continue to cooperate.

A police statement at the time read: "Two unknown offenders approached him and gained his attention by yelling out racial and homophobic slurs".

A week before the incident, Smollett told police he received a threatening letter at work. A police spokesman says the two are no longer considered suspects and that investigators have new evidence to consider as a result of questioning them.

Smollett's lawyers have said the actor was angered and "victimized" by reports he may have played a role in staging the attack. "Nothing is further from the truth and anyone claiming otherwise is lying".

What was especially weird was that one of the brothers had actually worked on Empire with Smollett as an extra.
